If you are a tenant in a Linstone house, you have the right to undertake alterations
or improvements to your home providing you first obtain permission in writing
from Linstone.
Consent will be conditional on the work being carried out to an acceptable
standard and other necessary approvals being obtained e.g. planning permission
or building warrants.
We would not unreasonably withhold consent, but would expect that certain conditions
be met regarding standards and workmanship.
Application forms are available from Linstone’s office and you should
receive a response within 28 days of providing all requested information. If
you are refused permission you have the right of appeal to the Sheriff Court.
Any work which you carry out will not be taken into account when determining
future rent levels.
Replacement of existing components of your home e.g. windows will be maintained
by the Association, depending on the specification used. Installation of additional
components e.g. shower will be your responsibility to maintain.
Certain improvements may qualify for a payment of compensation should you decide
to terminate your tenancy and move away. These include:
• Central heating.
• Sanitary ware/shower
• Double or secondary glazing
• Insulation/draught proofing
• Kitchen units
• Rewiring
• Security measures (excluding burglar alarm system)
Other works like erection of an aerial or satellite dish, replacement doors,
etc are termed alterations and as such do not qualify for compensation.
Linstone has a formula, set by the Government, to work out how much compensation
would be due. It is dependent on amongst other things, the length of time the
improvement has been in place and the original cost of the work.
Claims will not be paid if the result of the calculation is less than £100.
The maximum compensation payment is £4000. There is a right to appeal
any decision regarding either compensation valuation or refusal to pay. This
must be notified within 28 days.
If you fail to apply for permission you may be asked to reinstate your home
to its original condition. Compensation will not be paid where permission was
refused/not requested.
