In addition to the normal Repairs Procedures and timescales, Linstone operates
the “Right to Repair” scheme as laid down by the Housing (Scotland)
Act 2001.
The Right to Repair scheme gives Linstone specific timescales to respond to
specific jobs. These vary between 1 and 7 days. If our contractor fails to respond,
the Tenant is entitled to instruct another listed contractor to carry out the
work and is entitled to compensation payment from the landlord.
Qualifying repairs up to a value of £350 include:
1 DAY
- Blocked or leaking drains/soil stacks/sinks, baths, wcs where there is no
other wc in the house.
- Complete loss of electrical power.
- Loss or partial loss of gas supply.
- Unsafe power or lighting socket or electrical fitting.
- W.C. not flushing (if no alternative).
- Loss or partial loss of space/water heating (if no alternative).
- Insecure external window/door/lock.
- Blocked flue to open fire/boiler.
- Significant leak or flooding from water or heating pipes, tanks or cisterns.
- Unsafe access path or step.
- Loss of water supply.
3 DAYS
- Partial loss of electrical supply.
- Partial loss of water supply.
- Unsafe timber flooring/stair tread/handrail/banister.
7 DAYS
- Mechanical kitchen or bathroom fan not working.
Alternative contactor
If a repair that is designated within the ‘Right to Repair’ category
is not completed on time, you have a right to instruct our alternative contractor.

Please note that if you fail to give access to allow the repair to be inspected
or carried out, your rights to instruct an alternative contractor, and be paid
compensation, will cease to apply.
Compensation
If we fail to complete your repair within the stated timescale, you have a
right to compensation. The Association checks on a monthly basis to see if any
qualifying repairs have fallen outwith timescale and makes any appropriate payments
direct to tenants. However, if you think you are entitled to compensation and
you have not received a compensation payment from us within 4 weeks of when
the repair was due to be completed, please contact the Association.
Where you are eligible for compensation, the Association shall pay you compensation
calculated as follows:
(a) £15 flat rate , plus
(b) £3 for every working day, the repair is overdue.
The maximum payment will be for £100.
If you are in rent arrears, any compensation that is due to you will be offset
against your rent arrear.
